Health Minister approves CCP
recommendation in NHS Kingston dispute
The Health Minister, Mike O’Brien,
has written to NHS Kingston on its long-running
dispute with Churchill Medical Centre (Churchill) agreeing with the Cooperation
and Competition Panel’s (CCP) recommendation for NHS Kingston to allow Churchill
to provide NHS funded services from a new surgery location.
Churchill, in referring NHS Kingston’s conduct to the CCP,
asked whether NHS Kingston, in refusing to grant Churchill an amendment to their
PMS contract to open up a new branch surgery in a new location, was consistent with the Principles and Rules of Cooperation and Competition (PRCC). NHS Kingston had
previously cited concerns about the expected impact on existing GP services in refusing
the application. The Department of Health carried out a further detailed analysis
of the CCP’s decision before agreeing with their findings.
The case is a good example of how the CCP proposes
to apply the PRCC to primary care in relation
to conduct cases, notwithstanding
the dispute resolution procedure under the National Health Service (Personal Medical
Services Agreements) Regulations 2004.
