Recent Developments in Procurement Law Seminar - 17 September 2008

The seminar explored recent developments in procurement law and practice including the new Competitive Dialogue regime and was attended by legal and procurement officers from local authorities and other public bodies.

Competitive Dialogue in Practice

This subject was presented by Matthew Wolton a Director at The Projects Partnership.

Matthew explained the details of the Competitive Dialogue process and addressed some key issues of concern. These included intellectual property/confidentiality, the involvement of funders/insurers and consultants, the costs of bidding and the length of dialogue. Matthew went on to explain the new Competitive Dialogue process for Building Schools for the Future, including the new Pre Qualification Questionnaire and the new Invitation to Participate in Dialogue (1) and (2). Matthew answered questions from delegates concerning the difference between Competitive Dialogue and the Negotiated Procedure, whether the Dialogue procedure was more cost effective, and would produce better quality bids, the scope for the procurement of a central provider for BSF schemes and the practical implications of the new BSF Invitation to Participate in Dialogue.

Recent Developments in Procurement Law and Practice

This subject was presented by Owen Willcox, a Senior Solicitor at The Projects Partnership. Owen considered in detail the practical implications of recent court decisions concerning the use of the Teckal (or ‘in-house’) exemption from compliance with the EU procurement regulations, and the extent of the obligation to identify and publish tender award criteria prior to the receipt of tenders. Owen also explained the terms of the Remedies Directive and how it might be applied to breaches of the EU procurement regulations.

Owen answered questions from delegates concerning the extent to which contracting authorities would be obliged to change their approach to tender evaluation, the implications for those services normally exempt from the full application of the procurement regulations (part B services) and the likely impact of the Remedies Directive.
